Manor of Ightenhill
The Halmot Court of The Clitheroe Estate Company Limited of their Manor of Ightenhill in the County of Lancaster holden at Burnley the twenty fourth day of October in the First year of the Reign of our Sovereign 'Lord King Edward of the Seventh over the United Kingdom of Great Britain and Ireland and in the year of our Lord One thousand nine hundred and one before Arthur Ingram ROBINSON, Gentleman, Steward there
Be it remembered that on the twenty ninth of August One thousand nine hundred and one In pursuance of a covenant contained in an Indenture of Mortgage bearing even date herewith and made between Hubert John GRIMSHAWE of Thorn Hill Poulton le Fylde in the County of Lancaster Gentleman of the one part and Henry Percival Witham GRIMSHAWE of Thorn Hill Poulton le Fylde aforesaid Gentleman of the other part And in consideration of the sum of Nine hundred pounds now due and owing by the said Hubert John GRIMSHAWE to the said Henry Percival Witham GRIMSHAWE (as the said Hubert John GRIMSHAWE doth hereby acknowledge) And of the further sum of One thousand pounds this day paid to the said Hubert John GRIMSHAWE by the said Henry Percival Witham GRIMSHAWE (the receipt whereof the said Hubert John GRIMSHAWE doth hereby acknowledge) He the said Hubert John GRIMSHAWE Doth by these Presents out of Court by a rod surrender and give up into the hands of the Lords of the said Manor by the hands and acceptance of Anthony Buck CREEKE Gentleman a Customary Tenant of the said Manor and sworn according to the custom thereof All those seven Shops and dwellinghouses situate on the North side of and fronting into Briercliffe Road (formerly called Burnley Lane) and the two Warehouses in Devon Place behind the same and the Land upon which the said Shops and dwellinghouses and Warehouses are erected and which is adjacent and belonging thereto situate in Burnley in the said County which said Shops and dwellinghouses and Warehouses have recently been erected upon the said land in the place of fifteen Cottages previously standing thereon and known as numbers 36, 38, 40, 42 and 44, Briercliffe Road aforesaid and numbers 3, 4, 5, 6, 7, 8, 9, 10, 11 and 12 Devon Place Together with the appurtenances to the premises hereby surrendered belonging or appertaining All which premises are of the yearly Copyhold rents to the 'Lords of the said Manor of One Penny and to which same premises under a different description thereof the said Hubert John GRIMSHAWE was on the eighteenth day of October One thousand and nine hundred admitted upon a Surrender dated the twenty ninth day of August One thousand nine hundred and duly made and passed to his use by Obadiah FOLDS James FOLDS and James Langfield WARD To The Use and E??oof of the said Henry Percival Witham GRIMSHAWE his executors administrators and assigns for the residue of a Term of Two thousand years created by a surrender dated the eighteenth day of September One thousand eight hundred and twenty three and made and passed to the use of John WHITTAM (upon which Surrender Admittance was granted on the twenty fourth day of October then next following) and by and under the yearly Copyhold rents suits and services therefor due and of right accustomed according to the custom of the said Manor Subjectnevertheless to the proviso for redemption and to other the power and provisions mentioned ? expressed or implied of and concerning the same premises in and by the said Indenture of even date And hereupon comes the said Henry Percival Witham GRIMSHAWE by William Titherington WOOD his 'Attorney and desires to be admitted to his Fine Proclamationthereof being made and no person forbidding the same then the said premises with the appurtenances are granted by the sais Steward to the said Henry Percival Witham GRIMSHAWE To have and to hold to him his executors administrators and assigns for the residue of the Term and number of years aforesaid according to the custom of the said Manor Subjectnevertheless as in the above written Surrender is mentioned and referred unto and not oherwise [i]Yielding and Parting[/i] therefore yearly to the 'Lords of the said Manor and to their successors the rents and services therefore formerly due and of right accustomed and now he gives to the said 'Lords for Fine ? Onepenny by the pledge of Thomas THORNBER, Gentleman
