The Mayor, &c., of Burnley v. Mr. W. Gregory.

Among the property proposed to be taken by the Corporation, for the purpose of a market, is a house which fronts to Curzon-street, the back premises being in Curzon-street East. The property was formerly in two houses, back to back, but was some time since made into one. There is no yard, ash-pit, or privy accommodation belonging to it. The Corporation offered Mr. Gregory £220 10s for the property; he asked £450. The case came before the sherriff's assessor, James J. Aston, Esq., barrister, and a jury of twelve, selected from Burnley, Padiham, and Marsden, at the Bull Inn, on Thursday. - E. Dwyer, Esq., barrister, instructed by the Town Clerk, appeared on behalf of the Corporation; Mr. Gregory conducted his own case. - Mr. J. Brierley, surveyor and valuer, Blackburn; Mr. Thomas Bertwistle, Blackburn, surveyor and valuer to the Burnley Union; Mr. Hitchon, surveyor and valuer, Burnley; the borough surveyor, Mr. Colburn; and Mr. Porter, a former owner of the property, were examined for the Corporation. The valuations, respectively, were £260, £254 13s. 4d., £220 12s. 6d., and £225 18s. Mr. Gregory had purchased the property about two years ago, from Mr. Porter, for £189. - The jury, after hearing the evidence, retired for a short time, and on their return gave their verdict for £260. This is the first case of the kind the Corporation have had in the purchase of property from the market.
